Terms & Conditions
1. General
By leaving an instrument with HIBIKI Woodwind Instrument Service for repair, servicing, adjustment, inspection, storage, or quotation, the customer agrees to the following terms and conditions.
2. Customer Responsibility for Insurance
Customers are responsible for arranging and maintaining their own insurance cover for their instrument and accessories at all times, including while the instrument is in the custody, care, or control of HIBIKI Woodwind Instrument Service.
Customers are encouraged to confirm with their insurer whether their policy provides cover while the instrument is being repaired or stored at a repair workshop.
3. Limitation of Liability
While reasonable care will be taken in handling and storing instruments, HIBIKI Woodwind Instrument Service shall not be liable for loss or damage caused by events outside reasonable control, including but not limited to theft, burglary, fire, flood, earthquake, natural disaster, vandalism, accidental events beyond reasonable control, or failure of third-party services or utilities.
4. Liability for Negligence
Nothing in these terms excludes liability for loss or damage directly caused by proven negligence or wilful misconduct by HIBIKI Woodwind Instrument Service.
5. Pre-existing Condition
Instruments presented for repair may already contain wear, previous repairs, hidden damage, fatigue, corrosion, cracks, or structural weaknesses.
HIBIKI Woodwind Instrument Service is not responsible for failure of aged, fragile, previously repaired, modified, or unstable components occurring during normal repair procedures.
6. Repair Estimates
Quotes and estimates are provided based on visible inspection only. Additional work may become necessary once the instrument is disassembled or further inspected. Customers will be contacted where practical before significant additional work proceeds.
7. Uncollected Instruments
If an instrument is left uncollected for an extended period and the customer cannot be contacted, HIBIKI Woodwind Instrument Service may take reasonable steps to contact the customer using the contact details provided.
If there is no response for more than 6 months after reasonable attempts to make contact, the instrument may be treated as uncollected or abandoned property, subject to applicable New Zealand law. Any further action, including disposal, sale, or recovery of unpaid costs, will only be taken in accordance with legal requirements.
8. Shipping and Courier Risk
Where instruments are shipped or returned by courier or freight service, HIBIKI Woodwind Instrument Service will take reasonable care in packing and arranging shipment.
However, courier and freight services are operated by third parties, and delays, loss, or damage during transit may be subject to the carrier’s own terms, limits, and insurance arrangements.
Customers are encouraged to request courier insurance or confirm suitable transit cover where appropriate.
10. Acceptance of Terms
Leaving an instrument for repair, servicing, quotation, or storage constitutes acceptance of these terms and conditions.
